If Saddam Hussein had been kept alive indefinitely in captivity, the only result would have been repeated cases of die-hard Baathists abducting people as hostages in order to demand his release. Thus, even out of power, he would have continued to cause the terrorization and death of more innocent people.
The execution of duly-convicted criminals is not "murder" any more than the imprisonment of duly-convicted lesser felons is "kidnapping" or the imposition of fines on petty offenders is "theft".
